Terms of Use

By accessing or using JazaJaza, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the platform. JazaJaza is a product of Dime Machine Networks.

JazaJaza is an online classified listings platform that allows sellers to advertise goods and services and allows buyers to discover and contact sellers. We provide listing tools and optional paid advert activation via M-PESA. We are not a party to transactions between users and do not guarantee any listing, seller, or buyer.

You must be at least 18 years old and able to enter a binding contract to use the platform. You are responsible for ensuring that your use complies with applicable laws in Kenya and any other jurisdiction that applies to you.

You agree to:

• Provide accurate information when posting adverts.
• Own or have the right to sell or advertise anything you list, and not infringe third-party rights.
• Not post illegal, misleading, offensive, or harmful content, including scams, counterfeit goods, or prohibited items.
• Use a valid phone number in international format for contact and M-PESA activation where required.

We may review, edit, reject, or remove listings at our discretion without prior notice.

Publishing a listing may require payment via M-PESA STK push to the phone number you provide. Fees, if any, are shown before you confirm payment. Activation fees are generally non-refundable once a listing has been activated, except where required by law or at our sole discretion. Payment processing is handled by third-party providers; we are not responsible for mobile network or payment failures outside our control.

Sales, payments, delivery, and disputes are solely between buyers and sellers. JazaJaza does not process buyer-to-seller payments for goods, hold escrow, or guarantee delivery. Use caution: verify items, use secure payment methods, and meet in safe public places for in-person exchanges.

You must not:

• Use the platform for fraud, harassment, or illegal activity.
• Attempt to access accounts or data you are not authorised to use.
• Scrape, overload, or interfere with the operation of the site or its security measures.
• Misrepresent your identity or impersonate another person or business.

The JazaJaza name, branding, and platform software are owned by us or our licensors. You retain ownership of content you submit but grant us a non-exclusive licence to display, store, and distribute your listing content on the platform and in promotional materials related to the service.

The platform is provided "as is" and "as available" without warranties of any kind. See also our Disclaimer for additional limitations.

To the fullest extent permitted by law, JazaJaza, Dime Machine Networks, and their affiliates shall not be liable for indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill arising from your use of the platform or dealings with other users.

You agree to indemnify and hold harmless JazaJaza and its operators from claims arising out of your listings, your conduct on the platform, or your breach of these terms.

We may suspend or terminate your access at any time for violation of these terms or for any other reason. You may stop using the platform at any time. Provisions that by their nature should survive termination will remain in effect.

These terms are governed by the laws of the Republic of Kenya, without regard to conflict-of-law principles. Disputes shall be subject to the exclusive jurisdiction of the courts of Kenya, unless otherwise required by mandatory law.

We may update these Terms of Use from time to time. Continued use after changes are posted constitutes acceptance of the revised terms.
